What is mediation?

Mediation is a way of resolving a dispute - any dipute. It is an alternative to expensive, stressful, time consuming legal proceedings.

How does it work?

The mediator will arrange a meeting with the parties preferably at a neutral venue. The mediator will work hard with the parties to find a solution which all the parties can accept. Often the mediator will shuttle between the parties but always the focus is on helping the parties solve their own dispute.

What are the benefits of Mediation?

Speedy resolution – Mediation sessions can be arranged at short notice unlike court or arbitration hearings. A swift resolution of a dispute can free up valuable financial and human resources.
Cost savings – Substantial savings in legal costs and management time can be made.
Flexibility – Mediation sessions do not use formal rules of evidence and although they are carefully structured the mediator will follow a process best suited to the circumstances of the dispute.
Identifies the real issues – The mediation process helps parties to identify and focus upon the real issues in dispute. Even if the meditation does not produce a settlement on the day this focussing on the real issues can often lead to resolution shortly thereafter.
Confidential - The whole process is confidential. Nothing that is done at a mediation can prejudice any ongoing legal proceedings.

Who is the mediator?

Philip Hesketh is a solicitor with 17 years litigation experience. He has been trained and accredited as a mediator by the Alternative Dispute Resolution Group.

How much does it cost?

The fees are agreed in advance and depend on the amount in dispute and the complexity of the issues. Some examples:

up to £15,000 in dispute:-

£250 per party for a mediation of up to 3 hours; excess hours at £85 per hour per party.

£15,000 up to £50,000 in dispute:-

£450 per party for a mediation up to 4 hours; excess hours at £100.00 per hour per party.
